You could research the Company online and call the phone number listed on the website to check if it has actually contacted you and if you appear in its database with debts for collection. Large and established companies are members of associations and participate in industry activities, so you could check whether the agency that contacted you is a member of local industry organizations (e.g., the Association of Collection Agencies in Bulgaria and ACA International – The Association of Credit and Collection Professionals). You can also verify the legitimacy of the company by contacting your creditor, who will confirm that they have a contract with us. In addition, companies that collect debts after purchasing them through a cession agreement should be registered in the Register of Financial Institutions maintained by the BNB. You can check on the BNB website whether the company appears in the register.

Companies that work in the field of collecting overdue receivables are Personal Data Administrators and are responsible for their proper and lawful storage. This means that all procedures regarding the processing and storage of personal data of the obligated persons are followed. The data is protected both within the organization itself (only authorized persons work with it) and from external unauthorized interference. As a personal data administrator, the company complies with the provisions of the General Data Protection Regulation for natural persons 679/2016 (“GDPR”) and the Personal Data Protection Act and is subject to regulation by the Commission for Personal Data Protection, which guarantees our partners and clients peace of mind and security when entrusting us with personal data for processing.

The debt collection actions used by “Agency for Control of Overdue Debts” AD are as follows: sending notification letters and text messages, electronic correspondence, phone conversations and voice messages, sending written correspondence, concluding agreements. The main purpose of these actions is to reach an agreement with you for the payment of your debt. For this purpose, we analyze all possibilities for repaying the unpaid debt and offer individual payment solutions. After signing the agreement, it is extremely important that it is strictly adhered to. This guarantees you fewer additional costs and prevents enforcement actions against your property.

The Agency for control of outstanding debts has the right to send you an invitation containing information about your debt based on a contract between you and your creditor. The best response from your side is to contact us both by phone at 0700 200 27 (without additional charges, according to your tariff plan), and by email at clients [at] debtagency.bg. We will inform you about your debt and provide you with options for its repayment. We often give you the opportunity to postpone or temporarily reduce your debt installments. If you do not contact us, you would not be able to use these options and your debt collection may proceed to the judicial phase, where costs increase significantly. In case there has been a misunderstanding and your debt mentioned in the invitation has been paid, or if the received call and/or letter is for a person you do not know or who no longer lives at the specified address, it would be best to call us at 0700 200 27 (without additional charges, according to your tariff plan), and share the situation with us so we can verify and avoid future misunderstandings, as well as inform us about the change and tell us if you know the new phone number and/or address of the person, so we can contact them and not bother you anymore.

Any creditor can decide to sell their receivable. This sale is called a cession. The transferred receivable passes to the new creditor with all privileges and securities. The consent of the debtor or their signature is not required for the cession. When the new creditor is authorized to do so, they notify the debtor of the cession. After the transfer of the receivable, the debtor can and must make payments only to the new creditor.

When you sign a contract with a company, you agree that in case of payment delay, contact will be made with you. Based on a contract concluded between us and the company, we act as your creditor or as its representative. The conversations conducted by our operators are always in a good tone and their only purpose is to understand the reason for non-payment of debts and to help you stabilize your personal finances.

Inaction is the worst option for action in such a situation and is not a solution to the problem, but can only deepen it. If you are convinced that the claim is unfounded, notify us and we will investigate the case. If you are aware that the claim is lawful, but you are unable to pay at the moment, it is also best to contact us to conclude an agreement for rescheduling the debt. If you try to hide, this can only lead to the accumulation of additional costs on your debt. If you pay off the debt completely, you could significantly improve your credit rating, which significantly increases your ability to access new loans and goods on installment.

The Agency for control of outstanding debts follows best practices in debt collection, and also cares about its good reputation in society. Our practice is not about constant messages and reminders. Once we have already contacted you or you have called us or written an email and we have informed you about your debt, we have taken the first step towards settling your relationship with us. If you stop fulfilling the agreement or fail to make the promised payments, the Agency for control of outstanding debts will notify you about initiating legal actions against you.

If the amount due is large and you are unable to pay it at once, the best option is to contact us and discuss the situation and possibilities for rescheduling the debt. Usually, a repayment scheme is offered that is tailored to your income. And yet it is important to know that quick repayment of the debt will save you the accrual of both interest for delay and additional costs for debt collection. Otherwise, the debt could increase significantly.

You are already listed in the Central Credit Register at the BNB as a non-performing payer. This means that in the future you will not be able to use loans, take goods on installment, etc., until you cover your debts. In case the out-of-court collection methods do not achieve results, a judicial procedure will be initiated against you, which includes the formation of a private civil case and after the issuance of an enforcement order, an enforcement case is formed before a competent bailiff. To initiate the judicial process, court costs will be paid according to legal norms, which will significantly increase the debt and subsequently will be paid by you yourself. After the case is completed, it is handed over to a bailiff, who can garnish your wages, your bank accounts, your property, and, as a last resort, resort to selling it at a public auction.

In view of the above, it is much better for you to contact “AKPZ” AD to reach an agreement for out-of-court settlement of the obligation. If you pay off the obligation in full, you could significantly improve your credit rating, which greatly increases your ability to access new loans and installment purchases.

The above fees are valid for issuing a document for up to 3 obligations. For each subsequent obligation, an additional fee of 10 BGN /5.11 EUR/ is charged.

The fees include: processing of the request, requisition from the archive, covering transportation costs from the archive to the company’s headquarters, checking for requisites, courier services, copying or engaging an employee for scanning and sending by email – the fee is paid in advance and is non-refundable. The above documents are provided only after a written request is deposited on paper or another durable medium duly signed personally by the debtor or by an authorized representative with a notarized or attorney power of attorney, with the execution/response period being 30 working days from the date of payment of the fee.
